These terms and conditions govern your use of 4UBenefits.com (the “site”).  By using this site, you agree to these terms and conditions.  For convenience, these terms and conditions refer to 4U Benefits, LLC, a Michigan limited liability company, as “we” or “us,” to users as “you,” and to this web site, 4UBenefits.com, as the “site.”

We may, from time to time, modify or remove these terms and conditions.  If we do, this posting will be updated, and the changes will be effective no earlier than thirty (30) days after they are posted, unless you are otherwise notified by us.  You should periodically visit this part of the site to review the terms and conditions.  [The terms and conditions were last updated on July 24, 2008.]

Note that term products purchased through the site will automatically renew for subsequent terms unless you inform us otherwise.  Please refer to the specific product descriptions and to your personally identifiable information for further detail.

Cancellation Rights Within 30 Days

You may cancel the Membership Plan for a full refund within 30 days from the Purchase Date.  To cancel, do the following:  Log onto www.4ubenefits.com and select "Contact Us".  Write "I wish to cancel", include your name, Benefit ID#, and reason for cancellation.  All Membership materials, Membership cards, and all other forms, materials and products must be returned to: 4U Benefits, PO BOX 590, Ada, MI 49503.

Cancellation And Non-Renewal

4U Benefits can cancel or choose not to renew this Membership or coverage.  If this happens, 4U Benefits will notify you at least 60 days in advance of the expiration of this coverage.  Such notices need not be given if substantially similar replacement coverage takes effect without interruption.  If the Membership or coverage is canceled or non-renewed by 4U Benefits the coverage benefits will continue in force until the expiration date of your Membership.  Coverage will still apply to claims that occurred prior to the date of such cancellation or non-renewal, provided all other terms, conditions, and exclusions of coverage are met.

Warranties and Disclaimers

Although we have attempted to provide accurate information on this site, we assume no responsibility for the accuracy of the information contained herein.  We may change the programs or products mentioned at any time without notice.  Mention of third party products or services is for informational purposes only and constitutes neither an endorsement nor a recommendation.

Except as expressly provided otherwise in a written agreement between you and us, all products and services on this site are provided “as is” without warranty of any kind, either express or implied.  Without limiting the foregoing, we make no warranty that:

General Legal

If any of these terms and conditions is held to be invalid or unenforceable, then such provision will be enforced to the maximum extent permissible so as to effect the intent of these terms and conditions, and the remainder of these terms and conditions will continue in full force and effect.  The failure of any party to exercise or enforce any rights will not constitute a waiver of such right.  You agree that any cause of action related to this site must commence within one (1) year after the cause of action arose.

Mandatory Binding Arbitration

In the event of any dispute arising out of or connected in any way with the operation or maintenance of the site, or use of the site, upon the request of either party such dispute shall be submitted to binding arbitration before a single arbitrator subject to the Commercial Arbitration Rules and Commercial Dispute Resolution Procedures of the American Arbitration Association then in effect.  Such binding arbitration shall be in lieu of and a required alternative to civil litigation.  Any such arbitration shall be conducted in Grand Rapids, Michigan, at a mutually convenient location and the parties shall each bear all of their respective costs and expenses associated with arbitration, including attorney’s fees, except to the extent determined otherwise in the arbitration award.  The arbitrator shall be selected from the list of Civil Neutral Arbitrators provided through the offices of the American Arbitration Association located in Southfield, Michigan, or from such other list as may be agreed to in writing between the parties.

Security of the Information Collected

The security of the information that you provide to us is very important to us.  Hence, we have taken several measures to protect your information.  All transactions involving sensitive information, such as your credit/debit card number, are conducted using a service called Secure Sockets.  This service provides increased security to the information as it is transmitted to the site.  We will only use your credit/debit card number for the processing of our payment.  Other sensitive information that we may collect will not be disclosed to third parties unless we are required to do so by law.  In the event that our security system is breached, we will attempt to notify you as soon as possible.
